Resident Denied Property Rights

Dear Editor;

This letter is written at a moment of great concern and in support Terio’s letter to the Editor dated June 10, 1998, whereas the Philipstown Chairman of Assessor’s Office has "omitted" Terio’s 5 acre vacant land (without authority and/or permission) split said 5-acre vacant land located in an R-80 2-acre zone into 4-separate parcels, in which is illegal and in violation of the Philipstown subdivision regulations.

As further noted in said letter to the Editor dated June 10, 1998, Terio has owned said 5-acres since 1988 in which paying Town and School taxes through 1997. But in 1998 the Philipstown Clerk refuses to receive town taxes for subject 5-acres because the 5-acres was no longer on the Philipstown Assessment Tax Rolls, without reasons or otherwise.

Terio, has exhausted all his remedies to the Board of Assessment Review, Board of Assessors, Putnam County Tax Agency, and Commissioner of Finance, Putnam County.

Upon information and belief, as noted above "they" refuse to explain to Terio the basis for their actions in regard to said, omitting the 5-acre vacant land into 4- separate parcels in 1997, in which is a denial of the equal protection of the law. In other words denied reasons for omitting the 5-acres from the assessment tax rolls.

Moreover the Putnam County Legislature, was fully aware of the subject 5-acre vacant land in 1998. However as of this time/date the County Legislature upon information and belief has not addressed this subject issue or otherwise.

In fact the Putnam County Assistant County Executive expressed his opinion, letter dated January 8, 1998, which states that said 4-parcels are illegal only for zoning.

Upon information and belief in March 1996, the Putnam County-Town of Philipstown-Revaluation Project, 100 Percent of "full value". Said 5-acre vacant land was not addressed for 100% of full value, in which "Terio" taxes for such 5-acres per year of $463.00, assessment of $2,420.

Upon information and belief Chairman of the Board of Assessors issued new taxes in 1997 for said 5-acres assessment of $75,500.

Upon information and belief the Putnam County Commissioner of Finance has entered a County Lien against Terio’s said 5-acre vacant land in the Putnam County Clerk’s Office in 1998 thru 2001 in the amount of over $19,000.00.

If someone does not intervene as noted above it may again and maybe to other property owners.
