Leibell's Legislation to Expand the Crime of Compelling Prostitution is Signed Into Law

On June 7, Governor Pataki signed into law legislation that will now include the crime of compelling prostitution among a list of other designated offenses for which a DNA sample and Sex Offender Registration is required. This new law sponsored in the Senate by Senator Vincent L. Leibell (40th District) will further expand the crime of compelling prostitution by now requiring that those convicted of the crime provide a DNA sample for the State's DNA data bank and also register as a Sex Offender.

Last year, Senator Leibell sponsored legislation that established a new class B felony of compelling prostitution (Chapter 450 of the Laws of

2005). That crime is defined as follows: when someone 21 years or older knowingly advances prostitution by compelling a person who is less than 16 years old, by force or intimidation, to engage in prostitution.

"There is no more important role for government than providing protection to our State's children," Senator Leibell said. "This bill adds to the new crime we established last year, and helps to further deter those who would seek to abuse children. We need to be ever vigilant in this area and do all that we can to ensure that our children are never subjected to this terrible abuse," Senator Leibell concluded.
