Philipstown Man Violated Order of Protection
Putnam County Sheriff Donald B. Smith reports the arrest of a Town of Philipstown resident on October 7, 2006. The defendant is charged with harassment and criminal contempt after allegedly violating a court order of protection.
At about 10:30pm on October 5, 2006, Deputy Sheriff Andrew Kristan was dispatched to a Town of Philipstown residence for a report of a domestic dispute. Upon arrival at the Philipse Brook Road residence, Deputy Kristan initiated an investigation, which revealed earlier that day, the victim asked her husband, the defendant, for money to pay a child's piano instructor.
The defendant was irate at this request and became verbally abusive towards the victim. He also spat in her face before leaving the residence. At the time of the incident, an order of protection issued by Putnam County Family Court was in effect. On October 7, 2006, the defendant
turned himself in to Deputy Kristan at Sheriff's Department headquarters, where he was charged with Criminal Contempt in the Second Degree, a class A misdemeanor, for violating the court order, and Harassment in the Second Degree, a violation. The defendant's identity is being withheld due to the fact that disclosure would also identify the victim.
The defendant was arraigned by Town of Putnam Valley Justice Louis DiCarlo, acting on behalf of the Town of Philipstown Justice Court, and released on his own recognizance. During arraignment, Judge DiCarlo issued another protective order on the victim's behalf. The defendant is scheduled to appear in the Philipstown Justice Court at a future date.
If convicted of the contempt charge, the defendant could face up to one year in jail and a fine of up to $1,000, while the violation is punishable by a fine.
