Driver in PV Cited for Revoked License, Marijuana
Putnam County Sheriff Donald B. Smith reports that a motorist from Carmel was arrested in Putnam Valley on Saturday, December 16, 2006 for driving with a revoked license and possession of marijuana. Daniel R. Hutchby, aged 21, was arrested after a deputy sheriff stopped him for a moving violation.
According to the Sheriff’s Department, at about 10:20pm on Saturday, Deputy Brian Aisenstat pulled over Mr. Hutchby’s Hyundai on Bryant Pond Road after the driver failed to signal a turn. During the traffic stop, Deputy Aisenstat reportedly smelled the odor of marijuana emanating from within the car and then spotted a quantity of the drug in plain view on the center console. The
deputy ran a computer check on Mr. Hutchby’s driver license. That check indicated that the Carmel man’s license had been revoked back in September for three speeding violations committed within eighteen months.
Deputy Aisenstat charged Mr. Hutchby with Aggravated Unlicensed Operator in the Third Degree, a misdemeanor, Unlawful Possession of Marijuana, a violation, and Failure to Signal a Turn, an infraction. The license charge could result in a jail sentence and fine: the marijuana offense and infraction are punishable by fines. The defendant was issued an appearance ticket and released on his own recognizance pending an appearance in the Town of Putnam Valley Court on January 9, 2007.
