Legislature Approves Tentative Settlement for Marathon Battery Property Community/Senior/Nutrition Center and additional public parking could be constructed in Cold Spring by Margaret Sternberg
At the December 28, 2006 year-end meeting of the Legislature, in addition to numerous other resolutions that were passed, the Legislature approved the pursuit of a settlement in accordance with a December 22, 2006 proposed settlement of the Kearney Properties litigation in the Village of Cold Spring.
The Kearney property is commonly known as the Marathon Battery Property in Cold Spring.
Exact terms of the agreement were not disclosed, but Kearney would retain all but two-acres of the approximately 8.6 acre parcel, on which town homes for those age 55 and older would be built.
Under the proposed settlement, on the two acres set aside, a 5,000-square foot Community/Senior/Nutrition Center could be constructed and a paved parking lot able to hold at least 100 vehicles is planned in order to relieve parking congestion and support Main Street businesses. Kearney will supply some funds for the construction, with the remainder to be supplied by the Village of Cold Spring and State and/or Federal Grants.
In the event that the Community Center is not constructed within the agreed upon time period, the parcel will be retained by the County and the funds to be used for construction of the Center will be returned to Kearney.
In addition to approval of pursuing the settlement, there are 12 stipulations to the agreement that will be presented to Judge Andrew O’Rourke on January 3 for his approval. If he does not agree to the stipulations, the case would be expected to go to trial in February.
In other business, among the resolutions passed, the Legislature appointed Ronald Karabinos to the Putnam County Agriculture and Farmland Protection Board for a four-year term, to expire December 31, 2010. Sgt. Robert Cullen, of Southeast, Ronald Cummings, of Putnam Valley and Al Hosmer, of Philipstown, were re-appointed to the Putnam County Traffic Safety Board for three year terms, ending December 31, 2009.
The legislature approved the changes amending the Putnam County Plumbing and Mechanical Trades Licensing Law. The Legislature also approved a budgetary amendment, with a fiscal impact of $32,518 that forgave the cost of fringe benefits for Putnam Family & Community Services. The debt was “forgiven” because the charges had been billed to the organization subsequent to the completion of their 2005 independent audit and the creation of their 2006 budget, and no allocations could, at that point, be made for repayment of the funds.
The Legislature approved a budgetary transfer to cover expected year-end expenses; the transfer is made annually and carried no fiscal impact.
Also approved was a resolution approving classification and upgrading proposals regarding county personnel. Legislator Tony Hay voted against the resolution on grounds pertaining to the County having previously said there were no funds in the budget this year to support raises. All other legislators voted for the proposal, and Legislator Terry Intrary noted that the proposals had come from the County Executive and from Director of Personnel Paul Eldridge, not from within the Legislature.
