Letter Exchange Results in Arrest of Philipstown Man
Putnam County Sheriff Donald B. Smith reports the arrest of a Town of Philipstown resident on January 31, 2007 for allegedly violating a court order of protection issued in an intra-family matter. It is alleged that the defendant, a man who resides on East Mountain Road South, violated an order not to communicate with his wife by handing her a letter.
According to a complaint filed by the defendant's wife, the man handed her the prohibited correspondence on Sunday morning, January 28th, as the couple was carrying out a court-ordered exchange of child custody between them. Based upon the woman's complaint, Deputy Sheriff James Babcock arrested the defendant, who turned himself in at the Sheriff's Office Substation in Philipstown on January 31st.
Deputy Babcock charged the defendant with Criminal Contempt in the Second Degree, a class A misdemeanor, and arraigned him before Philipstown Town Justice Alan Steiner. The judge released the defendant on his own recognizance pending a February 14th appearance in the Court where, if convicted of the contempt charge, he could face up to one year in jail and a fine of up to $1,000.
