Believes Being "Illegally Assessed"
Dear Editor:

The Philipstown Chairman Assessor in respect to said four parcels is using Mr. Terio's property ID number and has entered on the Philipstown Assessment Tax Roll said four illegal parcels in which Mr. Terio, does not legally own in title or otherwise.

The Commissioner of Finance and Enforcement Officer is preparing a "Petition of Foreclosure against said four parcels" and further conduct a title search on the four parcels. However the Commissioner cannot conduct said title search because the four parcels where never legally recorded in the Putnam County Clerk's Office, the registrar of the deeds, in the name of Mr. Terio, or otherwise.

The Commissioner of Finance and its foreclosure attorneys' knew or should have known that Mr. Terio is not the "Indispensable Party", a party whose interest in such foreclosure is such that a final decree cannot be issued the final determination. Therefore an action may not proceed without an indispensable party must be joined because his nonjoiner would result in prejudice to his rights and the rights of other parties to the action.

It appears, the public taxpayers do not believe it could ever happen to them. Nevertheless it is happening to Mr. Terio. Therefore if the assessor or the commissioner is not stopped, their unlawful actions, allows them to do it again and again.

In this said foreclosure against Mr. Terio, the Supreme Court, and County Court, Putnam County does not have subject matter and personal jurisdiction, (the "four parcels" and "Mr. Terio",)

I have talked to many attorneys' concerning the four parcel issue, and all respond same: They cannot charge you taxes for property you do not own. But we do not handle this kind of case.

Beware buyers from buying real property that is not legally recorded with the registrar of the deeds.
