Parcels not Conveyed nor Deeded To the Editor:
Vincent Terio is subject to Foreclosure of Tax Lien on four parcels 39.-2-12.1, 0.13, acres, 39.-2-12.2, 0.05 acres, 39.-2- 12.3, 2.48 acres and 39.-2-12.4, 2.34 acres in the spring of 2007, located in the Town of Philipstown, New York, pursuant to Supreme Court, Putnam County, Index Number 1732/2004.
Mr. Terio, neither conveyed nor deeded nor subdivided said four parcels with the registrar of deeds in the Putnam County Clerk's Office or therwise. Mr. Terio cannot be liable for any taxes due and owning on said four parcels.
Mr. Terio, was further advised by the Putnam County Clerk's Office, that said four parcels were not subdidvided by Mr. Terio.,
The Philipstown assessor's office will show that the assessor is using Mr. Terio's real property assessment tax roll ID number for the purpose to create said four parcels which is now listed on the Philipstown assessment tax roll in 2007, in which Mr. Terio is subject to said foreclosure Index No. 1732/2004.
Whether the assessor's above action should be considered illegal and in violation under oath, pursuant to Real Property Tax Law.
Whether said four parcels are illegal to foreclosure by the Commissioner of Finance and Enforcing Officer, it should be considered also if the commissioner of finance is acting illegal and in violation under oath, pursuant to Real Prop-erty Tax Law.
Whether the Supreme Court, Putnam County under Index No. 1732/2004, has subject matter jurisdiction over said four
parcels that are not legally recorded in the Putnam County Clerk's Office, and personal jurisdiction over Vincent Terio, because I am not the owner in title of said four parcles or otherwise and because the assessor and commissioner of finace cannot subject a property owner only until a deed and RP-5217 has been recorded in the Putnam County Clerk's Office. In other words Mr. Terio is not the "indispensable part " a party to said foreclosure action.
