Narcotic Arrest Follows Stop for Vehicle Equipment Violation

Putnam County Sheriff Donald B, Smith reports the arrest of two men after they were found to be in possession of narcotics during a traffic stop for a motor vehicle equipment violation.

On October 9, 2007 at about 02:15am Deputy Alexander Ruhe was on routine patrol in the Town of Putnam Valley when he observed a vehicle with no exhaust operating along Oscawana Lake Rd. The deputy conducted a stop of the vehicle and observed the two male occupants attempting to secret an unknown item within the vehicle. After making contact with the subjects Deputy Ruhe determined that the operator of the vehicle's license was revoked for a prior Driving While Intoxicated conviction. A more extensive investigation and interview of the driver and passenger revealed that both subjects were in possession of "crack" cocaine and glass pipes used for;.smoking the illegal narcotics.

The driver, Peter Maggio, 45, of the Bronx was charged with Criminal Possession of a Controlled Substance in the 7th Degree, Aggravated Unlicensed Operation and Issued several traffic summonses.

The passenger, Eric Harvell, 43, of Putnam Valley was charged with Criminal Possession of a Controlled Substance in the 7th Degree.

Both defendants were transported to the Sheriff's Department headquarters in Carmel where they were processed and released on their own recognizance pending future appearances in the Town of Putnam Valley Justice Court.

If convicted of the narcotics charge, each defendant faces a maximum penalty of a monetary fine of up to $1,000 and/ or no more than one year in jail.
