County-Wide Alcohol Compliance Checks Net One Arrest

Putnam County Sheriff Donald B. Smith reports the arrest of a Mahopac (NY) man after investigators observed him selling beer to a 17-year-old youth.

On November 16, 2007, Investigators Vincent Martin and Nicholas DePerno Jr. of the Sheriff's Bureau of Criminal Investigation, conducted a county-wide inspection of establishments licensed to sell alcoholic beverages. The officers, utilizing a seventeen yearold confidential informant, checked retail businesses throughout Putnam County to see if sales people were checking valid identification of patrons to ensure that they are of legal age to purchase alcoholic beverages. More than twenty stores located in Putnam Valley, Carmel, Mahopac, Brewster, Southeast, Patterson and Kent were visited. Of the establishments checked, the sales clerk at only one establishment allegedly sold beer to the teen without checking for proper identification.

At about 3:40pm, the confidential informant appeared at the Mobil Mart, located at Route 6 in Mahopac for the purpose of purchasing beer. A sales clerk, identified as Mr. Lhakpa Sherpa of Mahopac allegedly sold a six pack of beer to the underage patron. He was arrested and charged with Unlawfully Dealing With a Child in the First-Degree, a class "A" misdemeanor. Mr. Sherpa was released after posting $200 cash bail and is due to appear in the Town of Carmel Justice Court on December 17, 2007. Additionally, investigators have contacted the New York State Liquor Authority for possible administrative action against the licensed premise.

A conviction of Unlawfully Dealing With a Child in the First Degree may be punishable by a term of imprisonment of up to one year in the Putnam County Correctional Facility.
