Suspicious Car Investigation Leads to Sexual Misconduct Arrest in Cold Spring
Putnam County Sheriff Donald B. Smith reports the arrest of a 19-year-old Philipstown man on sexual misconduct and child endangerment charges.
On December 29, 2007 at about 8pm, Deputy Thomas Corless was on patrol in the Town of Philipstown, when he observed a vehicle parked in the area of Horseman's Trail. Further investigation by the deputy revealed that the car was occupied by two individuals; a nineteen-year-old male and a fifteen-year-old female whom were engaging in consensual sexual activity. Deputy Cortess transported the pair to the Sheriff's Philipstown Substation and contacted Investigator Michael Nalbone of the Bureau of Criminal Investigation.
As a result of the officers' investigation, 19-year-old William Kivel of 3501 Route 9, Cold Spring was charged with Sexual Misconduct and Endangering the Welfare of a Child, both class "A" misdemeanors. He was arraigned before Philipstown Town Justice Stephen Tomann and remanded to the Putnam County Correctional Facility in lieu of $1,500 cash bail or $3,000 secured bond. Additionally, Justice Tomann issued a temporary order of protection prohibiting Mr. Kivel from having any further contact with the victim. Mr. Kivel Is scheduled to return in Philipstown Justice Court on January 9, 2008.
A conviction of either one of the criminal charges may be punishable by a sentence of imprisonment for a term of up to one year in the Putnam County Correctional Facility.
