Sheriff's Deputy, Other Motorist, Injured in Head- On Crash On Route 9 in Philipstown Dutchess driver faulted in crash, faces criminal charges
Putnam County Sheriff Smith reports that a sheriff's deputy was seriously injured on March 5, 2008 when his patrol car crashed head-on into another vehicle on Route 9 in Philipstown. The other driver, a woman from Dutchess County, was also injured and is facing criminal charges following the crash.
According to the Sheriff, at about 6:37am, Deputy Sheriff Matthew D. Boscia was patrolling alone in his marked cruiser, a 2005 Ford Crown Victoria, heading in a southbound direction on Rte 9. As he was passing the Putnam Glass establishment, about one mile south of Route 301, a northbound 1998 Ford Explorer driven by Ms. Michele DiVivo, aged 43, of Wappinger Falls, reportedly crossed over into the southbound lane and slammed head-on into the deputy's car.
Investigators report that the collision was witnessed by other uninvolved motorists. The witnesses stopped and a caller reported the crash by dialing 911 on a mobile telephone.
Sheriffs deputies and investigators, state troopers, the Philipstown Volunteer Ambulance Corps and North Highlands Volunteer Fire Department responded to the scene. Deputy Boscia was transported by ambulance to Westchester Medical Center in Valhalla, where he was admitted with fractures to his left leg, left ankle and left hand. Ms. DiVivo was taken by ambulance to Hudson Valley Hospital in Cortlandt and was later moved to Westchester Medical Center for treatment of a broken leg.
Deputy Boscia is 25 years old and has 13 months of service in the department.
Ms. DiVivo faces several charges: unlawfully driving her car across a double-yellow line, an infraction; driving while her ability was impaired by drugs, a misdemeanor; and vehicular assault in the second degree, a felony. She will answer those charges in Philipstown Court on March 26. Route 9 was closed from the time of the accident until about 9:30am, while investigators examined the scene to reconstruct how the crash occurred.
