Patterson Man Charged With DWI and Multiple Traffic Violations
Sheriff Donald B. Smith reports the arrest of a Patterson man for driving while intoxicated.
On June 14, 2008 at 11:40pm. Deputy Matthew Monroe was on routine patrol in the Town of Southeast when he observed a vehicle being operated in an erratic manner. The deputy stopped the vehicle and, upon approaching the vehicle, he detected a strong odor of an alcoholic beverage on the driver and the three passengers. The driver, Albaro Espinosa, 33, stated the passengers were intoxicated by alcohol and stated he was sober. The deputy also noticed neither of the front seat occupants were wearing seatbelts. A series of field sobriety tests were conducted to determine if the defendant was impaired by alcohol or any other substance, all of which he failed and a breathalyzer test revealed 0.18 SAC.
Deputy Monroe gave the Miranda warning and DWI refusal warning and arrested Mr. Espinosa for driving while intoxicated and numerous traffic violations. The defendant was detained overnight at the Putnam County Correctional Facility and was to appear in the Town of Patterson Justice Court on June 15, 2008.
Driving While Intoxicated is a Misdemeanor and if the defendant is found guilty of the charge he could face up to 15 days in jail and/or a fine of $500.
