RESOLUTION - ROARING BROOK LAKE

LEGAL NOTICE
RESOLUTION - ROARING BROOK LAKE
WHEREAS     Roaring Brook Lake Park district (the “District”) is a Special Improvement District created by the Town Board of the Town of Putnam Valley; and   
WHEREAS  the District owns and operates several properties adjacent to Roaring Brook Lake for the benefit of District residents; and
WHEREAS     District residents regularly utilize said properties for the storage and operation of personal, non-motorized watercraft including, but not limited to, boats; and
    WHEREAS use of District-owned properties and storage and launching of boats is limited to District residents and
WHEREAS identification of authorized boats is established by means of registration stickers issued to District residents and applied to their watercraft; and
WHEREAS numerous boats have accumulated on District-owned property which lack current (green) registration stickers and which are haphazardly stored in ways which risk injury to children and others using District-owned property; and
WHEREAS the Town Board wishes to identify all watercraft belonging to District residents by insuring proper registration thereof and to remove all watercraft not so registered.
NOW, THEREFORE, be it
RESOLVED, that all owners of watercraft stored and/or maintained on District- owned properties shall obtain and affix to the watercraft in a visible manner a green registration sticker, same to be obtained at no fee from the Putnam Valley District Clerk; and be it further
RESOLVED, that all watercraft located on District-owned properties and not displaying a green registration sticker shall be removed by their owners from District-owned properties no later than midnight, June 13, 2010; and be it further
RESOLVED, that unregistered watercraft found on District-owned properties after June 13, 2010 shall be deemed abandoned and will be auctioned by the District on June 26, 2010 at 2:30 P.M. at North Beach; and be it further
RESOLVED, that the net proceeds of such auction shall become funds of the District, and be it further
RESOLVED, that any unregistered watercraft offered for auction and not sold at auction shall be removed from the District-owned properties or destroyed, at the discretion of the District, and be it further
RESOLVED, that a copy of this Resolution shall be published in the Putnam County News and Recorder on May 12, 2010 and May 19, 2010; and be it further
RESOLVED, that a copy of this Resolution, along with a letter from Town Supervisor Tendy in the form attached hereto, shall be mailed to all District taxpayers no later than April 26, 2010 and be it further
RESOLVED,  that a copy of this Resolution shall be posted on the Putnam Valley website, and in the Putnam Valley Town Hall, within 5 days following its adoption.
