Separate sealed bids for the Indian Brook Road East Bank Stabilization Project will be received by the Town of Philipstown at the office of the Town Clerk, 238 Main Street, Cold Spring NY 10516 until 11:00 o'clock AM local prevailing time on Monday, August 20, 2012 and then at said office publicly opened and read aloud.

A prebid meeting will be held at11:30 o'clock AM local prevailing time on     Friday, August 10, 2012 at Philipstown Town Hall,

The Information for Bidders, Form of Bid, Form of Contract, Plans, Specifications, and Forms of Bid Bond, Performance and Payment Bond, and other contract documents may be examined at the following location:

Office of the Town Clerk, 238 Main Street, Cold Spring NY 10516

Copies may be obtained at the office of the Town Clerk located at 238 Main Street upon payment of $25.00 for each set. Any unsuccessful bidder or non-bidder shall be entitled to a refund of this payment in accordance with Section 102 of the General Municipal Law upon the return of such sets in good condition as determined by the Town.

Each bid shall be accompanied by acceptable form of Bid Guarantee in an amount equal to at least five (5) percent of the amount of the Bid payable to the Owner as a guarantee that if the Bid is accepted, the Bidder will execute the Contract and file acceptable Performance and Payment Bonds within ten (10) days after the award of the Contract,

The Town of Philipstown hereinafter called the OWNER, reserves the right to reject any or all Bids and to waive any informality or technicality in any Bid in the interest of the Owner.

STATEMENT OF NON-COLLUSION:

Bidders on the Contracts are required to execute a non-collusion bidding certificate pursuant to Section 103d of the General Municipal Law of the State of New York.

The Town of Philipstown hereby notifies all Bidders that it will affirmatively insure that in regard to any Contract entered into pursuant to this advertisement, minority business enterprises will be afforded full opportunity to submit bids in response to this invitation and will not be discriminated against on the grounds of race, color, or national origin in consideration for an award.

Attention of bidders is particularly called to the requirement as to conditions of employment to be observed and minimum wage rates to be paid under the contract. Bidders are also required to comply with the provisions of Section 291-299 of the Executive Law of the State of New York.

No Bidder may withdraw his bid within 45 days after the actual date of the opening thereof.

Local Law #6 of 2012

LOCAL LAW #6- Amending Article 7, Section 7.04 of The Putnam County Charter Entitled “Annual Operating Budget”

ABSTRACT PROVISION:

This Local Law Amends Section 7.04 of the Putnam County Charter by changing the submission and completion dates set forth in the budget process, by changing the date which the tentative budget is to be submitted to the Legislature  on or before October 1st of each year, by changing the date by which the Legislature is required to make changes to on or before October 28th of each year, by changing the date by which the tentative budget is adopted if the Legislature fails to act to on or before November 1st of each year, and by changing the date by which the County Executive shall veto any changes made by the Legislature to on or before November 8th of each year, and by which the Legislature shall convene to reconsider each item vetoed by the County Executive to on or before November 15th of each year.

LOCAL LAW #7- Amending Article 7, Section 7.05 of The Putnam County Charter Entitled “Capital Budget”

ABSTRACT PROVISION:

This Local Law Amends Section 7.05 of the Putnam County Charter by changing the submission and completion dates set forth in the budget process, by changing the date by which the Capital Projects Committee report must be submitted to on or before September 1st of each year and by which the capital budget shall be incorporated into the tentative budget and submitted to the Legislature on or before October 1st of each year.

LEGAL NOTICE

Sealed bids will be received as set forth in instructions to bidders until 10:30 a.m. on September 06, 2012,at the NYS Dept. of Transportation, Contract Management Bureau, 1ST FLOOR SUITE 1CM, 50 WOLF RD, ALBANY, NY 12232 and will then be publicly read. A certified or cashier's check payable to the NYS Dept. of Transportation for the sum specified in the proposal or a bid bond (FORM CONR 391) representing "25% of the bid total" as specified in the contract proposal must accompany each bid. Bids may also be submitted via the internet using Bid Express (www.bidx.com). The Department reserves the right to reject any or all bids.

Construction contract plans and proposals are sold only on compact disk (CD). The cost is $10 per CD, plus $8 shipping and handling if the CD is not purchased in person. The CD includes both the plans (if applicable) and the proposal in Adobe

Acrobat PDF file format. Plans and proposals in Adobe Acrobat PDF format are also available on Bid Express (www.bidx.com) for a monthly subscription fee.

CDs can be obtained from the NYSDOT, Plan Sales Unit, 1st Floor Suite 1PS, 50 Wolf  Road, Albany, NY 12232, (518) 457-2124; or from the Regional Office noted below. Requirements: NYSDOT requires that all bidders and subcontractors present evidence of experience and financial standing. Subcontracting Provisions: Subcontracting is permitted as described in the Standard Specification §108-05. *Please call Contracts at (518) 457-3583 if you need a reasonable accommodation for person(s) with a disability to participate in our program.

No Amendments are included on the CD. Amendments are posted on the NYSDOT and Bid Express Web Sites. The Contractor is responsible for ensuring that all Amendments have been incorporated into its bid. Notification on Amendments issued after a CD is purchased will be sent via e-mail to each person or firm purchasing CDs from the NYSDOT. NOTE: Amendments may have been issued prior to CD purchase. Contractors who purchased CDs must also check the NYSDOT Web Site (https://www.dot.ny.gov/ doing-business/opportunities/const-notices) for a list of all Amendments.

State Finance Law §139-j restricts contact with Department personnel after

advertisement or notice of a government procurement. Details are provided on the

Federally Aided Contracts identify a DBE Goal, and 100% NY State Funded Contracts identify both MBE and WBE Goals.
