LEGAL NOTICE

DEPARTMENT OF INTERIOR NATIONAL PARK SERVICE

Notice of Realty Action Proposed Exchange of federally-owned land for privately-owned land in Putnam County, New York.

I. The following described federally-owned land which was acquired by the National Park Service has been determined to be suitable for disposal of a fee interest by exchange. The authority for this exchange is Section 5(b) of the Land and Water Conservation Fund Act Amendments in Public Law 90-401, approved July 15, 1968, and Section 7(f) of the National Trails System Act, Public Law 90-543, as amended.

The selected Federal land is outside the boundary of the Appalachian National Scenic Trail and is not required for inclusion into that park unit area. Analysis pertinent to National Environmental Policy Act (NEPA) compliance has been completed for the property. NEPA compliance documentation is available upon request.

Fee ownership to the federally-owned property is to be exchanged: Tract 277-58 is a 0.61 acre parcel of land acquired by the United States of America by deed recorded in Deed Book (Liber) 1444 on Page 157 at the Putnam County Clerk’s office.

Conveyance of the land by the United States of America will be done by a Quitclaim Deed.

II. In exchange for the tract indentified above, the United States of America will acquire Tract 277-56, a 0.61 acre parcel of land, currently owned by James and Patricia Fitzgerald lying within the boundary of the Appalachian National Scenic Trail. Acquisition of this private land will provide unencumbered land upon completion of the exchange. The land is being acquired in fee simple with no reservations subject only to rights of record.

The value of the properties exchanged shall be determined by a current fair market value appraisal and if they are not appropriately equal, the values shall be equalized by payment of cash as circumstances require.

Detailed information concerning this exchange including precise legal descriptions, Land Protection Plan, and NEPA compliance are available at the National Trails Land Resources Program Center, 1314 Edwin Miller Boulevard, Martinsburg, West Virginia 25404.

For a period of 45 days from the date of this notice, interested parties may submit written comments to the above address. Adverse comments will be evaluated and this action may be modified or vacated accordingly. In the absence of any action to modify or vacate, this realty action will become the final determination of the Department of Interior.

Plans and proposals in Adobe Acrobat PDF format are also available on Bid Express (www.bidx.com) for a monthly subscription fee.

Requirements: NYSDOT requires that all bidders and subcontractors present evidence of experience and financial standing. No Amendments are included on the CD. Amendments are posted on the NYSDOT and Bid Express Web Sites.
