LEGAL NOTICE OF COMPLETION OF DRAFT DESIGN REPORT/ DRAFT ENVIRONMENTAL IMPACT STATEMENT NOTICE OF SEQR PUBLIC HEARING NEW YORK STATE DEPARTMENT OF TRANSPORTATION PROJECT IDENTIFICATION NO. 8327.37 ROUTE 9D – DRAINAGE IMPROVEMENT PROJECT TOWN OF PHILIPSTOWN PUTNAM COUNTY In accordance with the provisions of Article 8 of the Environmental Conservation Law, the Department of Transportation will conduct a public hearing which will be held in the Philipstown Town Hall, located at 238 Main St., Cold Spring, NY on December 19, 2012. The public hearing will consist of an open forum format from 6:30 – 8:30. The formal presentation portion of the hearing will begin at 7:00. The scope of the project is to relocate the stormwater from Route 9D that currently outlets into the drainage channel which crosses through private property located at 563 Route 9D. The proposed project will redirect the stormwater through a drainage pipe along Route 9D and outlet it into a stream channel approximately 350 feet north of its current location. The project will be constructed entirely in the Town of Philipstown of Putnam County. The New York State Department of Transportation, being the agency having principal responsibility for carrying out or approving the proposed project, is the lead agency pursuant to Part 15 of Title 17 of the Official Compilation of Codes, Rules and Regulations of New York State (17 NYCRR Part 15). A Draft Design Report/ Draft Environmental Impact Statement (DR/ DEIS) has been completed for this action; it assesses the effects of the project on noise, air quality, water quality, properties, cultural and historic resources, hazardous wastes, ecosystems, threatened species, visual resources, and environmentally sensitive lands. The DR/ DEIS shows the project to
have minor impacts on the wetland area near Route 9D where the new outlet will enter the stream. Other minor temporary disturbances will also be associated with the proposed stream bank repair and protection along spot locations of the stream channel. The open forum format will consist of displays and information tables staffed by Department representatives familiar with the planning, engineering, traffic, environmental and right-of-way aspects of the project. Information, and the opportunity to submit written or oral comments, in confidence if desired, will be available at any time within the above stated time period. Questions should be directed to the staff attending the displays. All interested persons and effected property owners will be given the opportunity to express their views concerning the economic and social effects of the action, its impacts on the environment and its consistency with the goals and objectives established by the community. The proceedings will be recorded. Persons may make oral statements and/or file written statements. Written statements submitted at the hearing or mailed to the Regional Contact no later than January 4, 2013 will be made part of the record. The Design Report and technical appendices are available for review at the Regional Office, 4 Burnett Blvd., Poughkeepsie, NY and the Philipstown Town Hall, located at 238 Main St., Cold Spring, NY. The DR/ DEIS describes the needs and objectives of the project, and evaluates the engineering, social, economic, and environmental effect of the proposed design.
